Several weeks ago, Finney Law Firm (FLF) did a webinar for EmpowerU on the relief offered to small business and self-employed under the Coronavirus Aid, Relief, and Economic Security Act (CARES Act).  One of the main focuses of that webinar was the Paycheck Protection Program (PPP), which offers forgivable loans to small businesses.  Since that time, over 4.5 million companies have received PPP loans totaling over $510 Billion.  And, approximately $100 Billion in funding for PPP loans remains unused.
   If you are one of the small businesses or self-employed that received a PPP loan (or if you are considering applying for one), you’ve likely been wrestling with questions on how to make sure your loan is forgiven. The SBA has now provided significant additional guidance on PPP loan forgiveness, including, for example:
  • New rules on what payroll counts toward forgiveness
  • New rules on what you can spend PPP funds on other than payroll
  • New rules on when you must spend PPP funds
  • How you calculate your reduction in loan forgiveness if you decrease employees and/or compensation (including safe harbors that help preserve PPP forgiveness)
And, Congress is considering changing the rules to allow more time and flexibility in spending the funds.  In this webinar, FLF will outline these new rules and the potential changes, and how to maximize your PPP loan forgiveness.

   Brad Wenstrup was elected in 2012 to represent the people of Ohio’s Second Congressional District in the United States House of Representatives.  He has been deeply involved in the PPP loan program to help businesses.  He brings experience as a doctor, Army Reserve officer, Iraq War veteran, and small business owner to help Congress tackle the economic and security challenges facing the nation.
   In the 116th Congress, Brad serves on the House Committee on Ways and Means and the House Permanent Select Committee on Intelligence. He previously spent six years on the Armed Services Committee and the Committee on Veterans’ Affairs. As a member on the Ways and Means and Intelligence Committees, Brad is working to address the national health care situation and systemic poverty issues, while strengthening our national security. He has long been a voice of support for southern Ohio’s veteran community.
   A Cincinnati native, Brad graduated from Saint Xavier High School and the University of Cincinnati.  He went on to earn a medical degree in Chicago as a podiatric physician and after completing his surgical residency he established private practice in Cincinnati, treating patients for 26 years.
   During his time in Congress, Brad is fulfilling his Reserve duties by serving as the Medical Policy Advisor for the Chief of the Army Reserve as well as seeing patients at Walter Reed National Military Medical Center in Bethesda.    Brad and his wife, Monica, reside in Cincinnati with their children Brad Jr. and Sophia.   Brad will be joining us on the Webinar on Tuesday night, June 9.
   Chris Finney is a licensed attorney in Ohio, Kentucky and the District of Colombia, as well as a licensed Ohio real estate title insurance agent. Mr. Finney was named Ohio Lawyer of the Year in 1998 at the age of 37.

   The height of Mr. Finney’s legal career to date was reached with two wins before the United States Supreme Court in June of 2014, for clients suing the Ohio Elections Commission over their administration of the Ohio “False Claims” statute, empowering a panel of bureaucrats to judge the truth or falsity of statements made during election campaigns.  Mr. Finney challenged the statute, and the criminal penalties attendant thereto, in a series of cases spanning five years.  After losing the issue before three separate District Court judges, and all fifteen Judges on the 6th Circuit Court of Appeals (an 0-18 losing record on this issue), Mr. Finney won back-to-back 9-0 decisions on the cases from the US Supreme Court.
